1. About these Terms
These Terms and Conditions ("Terms") govern your access to and use of thebridaljourney.com.au, its subdomains, mobile-optimised versions, official social media accounts, newsletters, and any related services (collectively, the "Site").
The Site is operated by The Bridal Journey Pty Ltd ACN 658 629 737 (ABN 52 658 629 737) ("TBJ", "we", "us" or "our"). Our registered office is Level 1/4-6 Gilbert St, Torquay VIC 3228 and our postal address is PO Box 2111, Geelong VIC 3220.
By accessing or using the Site, subscribing to our newsletter, submitting content, purchasing a service, or entering any commercial arrangement with us, you agree to be bound by these Terms together with our Privacy Policy and (where applicable) the Marketplace Terms, Vendor Subscription Agreement, and any signed Brand Partnership Agreement. If you do not agree, you must not use the Site.
2. Definitions
In these Terms:

"AU Consumer Law" or "ACL" means the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

"Commercial Partner" means any business, brand, vendor or organisation that enters a paid commercial arrangement with TBJ, including Vendor Directory subscribers, Marketplace Sellers, and partners under a Brand Partnership Agreement.

"Marketplace" means the preloved goods listings and sale facilitation function of the Site, governed by the Marketplace Terms.

"Vendor Directory" means the paid directory of wedding industry vendors, governed by the Vendor Subscription Agreement.

"TBJ Content" means the editorial writing, articles, brand identity, logos, designs, layout, software, code, original photography produced by TBJ, and all other content originated or commissioned by TBJ.

"Third-Party Creative Content" means photographs, videos, designs, illustrations and other creative works featured on the Site that are owned by third parties (including photographers, videographers, designers and contributors) and published by TBJ under licence.

"User Content" means any material that you submit, upload, post, transmit or otherwise make available to TBJ, including but not limited to wedding submissions, marketplace listing content, vendor listing content, comments, photographs, and survey responses.

"You" means any visitor to or user of the Site.
3. Acceptance and eligibility
To access general editorial content on the Site, you must be at least 16 years of age. To register a Vendor Directory account or to use the Marketplace as a buyer or seller, you must be at least 18 years of age and have legal capacity to enter binding contracts.
If you are accessing the Site on behalf of a company, partnership, trust or other entity (including as a Vendor or Commercial Partner), you warrant that you have the authority to bind that entity to these Terms, and you and the entity will be jointly and severally bound.
4. Editorial nature of the Site
TBJ is an editorial media platform covering bridal fashion, real weddings, vendors, and industry news. Content on the Site is published in good faith and for general information, inspiration and entertainment purposes only. While we take reasonable care, content is not professional advice (including legal, financial, medical, or wedding planning advice) and you should not rely on it as the sole basis for decisions.
5. Vendor features and editorial recommendations
Articles, vendor features, Vendor Directory listings, supplier shortlists, and similar editorial content reflect the opinions of TBJ and its contributors at the time of publication. Inclusion of any vendor, venue, brand, or supplier on the Site is not a guarantee of suitability, quality, availability, pricing, or performance. You are responsible for conducting your own due diligence before engaging any vendor, venue, or supplier, and any contract you enter is solely between you and that party.
TBJ is not an agent, broker, or representative of any vendor or venue featured on the Site, except where expressly stated in a signed Brand Partnership Agreement.
6. Affiliate links and sponsored content
Some content on the Site contains paid placements, sponsored partnerships, gifted features, brand collaborations, or affiliate links. We use the affiliate platform ShopMy and may use other affiliate networks from time to time. Where TBJ earns a commission or receives consideration in exchange for featuring a product, brand, or service, we disclose the commercial relationship in line with the Australian Consumer Law, the Australian Association of National Advertisers (AANA) Code of Ethics, and the ACCC's guidance on influencer disclosures.
Engaging with affiliate links or sponsored content may result in third parties collecting information about you (subject to their own privacy practices). Please see our Privacy Policy for details.
7. Intellectual property: TBJ Content
All TBJ Content is owned by or licensed to The Bridal Journey Pty Ltd and is protected by Australian and international copyright, trade mark and other intellectual property laws.
Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable licence to view, download and print TBJ Content for your own personal, non-commercial use only. You must not:

Copy, reproduce, republish, upload, post, transmit, sell, distribute, communicate to the public, or commercially exploit TBJ Content in any way without our prior written consent.

Modify, adapt, translate, reverse engineer or create derivative works from TBJ Content.

Use TBJ Content for any commercial purpose, including on a vendor website, in marketing material, in print collateral, in pitch decks, or in social media, without a written licence from us.

Frame, embed or mirror any part of the Site within another website without our prior written consent.

Remove or alter any copyright, trade mark, byline, watermark, or other proprietary notice.
8. Intellectual property: Third-Party Creative Content
Wedding photographs, real-wedding imagery, designer collection imagery, styled shoot photography, videography, illustrations, and other creative works published on the Site are the intellectual property of their respective creators (including photographers, videographers, designers and other creative professionals).
TBJ publishes Third-Party Creative Content on the basis of permissions and licences granted by the rights holders or by the submitting party who warrants that the rights holders have consented. The publication of Third-Party Creative Content on the Site does not transfer, waive, or diminish the rights of the original creator.
You must not download, reproduce, share, repost, screenshot for commercial use, or otherwise use any Third-Party Creative Content appearing on the Site without obtaining prior written permission directly from the relevant rights holder. TBJ accepts no liability for any unauthorised use by users of Third-Party Creative Content.
9. Trade marks
"The Bridal Journey", the TBJ logo, the editorial mastheads, and associated marks are trade marks of The Bridal Journey Pty Ltd, including Australian Registered Trade Mark No. 2502301. You must not use any TBJ trade mark, name, or logo (or any mark substantially similar) in connection with any product, service, communication, or content, or in any manner likely to cause confusion or that disparages or discredits TBJ, without our prior written consent.
10. Prohibition on AI training and automated data collection
You agree not to use, and not to permit any third party to use, TBJ Content or Third-Party Creative Content appearing on the Site:

To train, fine-tune, develop, validate, test or improve any artificial intelligence model, machine learning model, large language model, generative AI tool, or similar technology.

To scrape, harvest, index, mine, extract or collect using bots, crawlers, spiders, scrapers, or any other automated means without our prior written consent.

To create any derivative or competing dataset, database or product.
This clause is in addition to, and not in substitution for, any other intellectual property protections that apply to TBJ Content and Third-Party Creative Content. Standard search engine indexing for the purpose of directing users to the Site is permitted.
11. Acceptable use
When using the Site, you agree not to:

Use the Site for any unlawful, fraudulent, defamatory, harassing, threatening or harmful purpose.

Interfere with or disrupt the Site, the servers or networks connected to the Site, or any other user's enjoyment of the Site.

Attempt to gain unauthorised access to any part of the Site, any user account, or any system.

Introduce viruses, worms, trojan horses, ransomware, malware or any other harmful code.
-
Impersonate any person, misrepresent your identity or your affiliation with any person or entity.

Engage in discrimination, harassment or hate speech directed at any individual or group on the basis of race, colour, religion, sex, national origin, ancestry, disability, marital status, sexual orientation, gender identity, gender expression, age, or any other protected characteristic.
12. User Content and submissions
If you submit User Content to TBJ - including but not limited to real wedding submissions, marketplace listing content, vendor listing content, comments, pitches, photographs, survey responses, or any other material - you grant TBJ a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable and transferable licence to use, reproduce, edit, adapt, publish, translate, distribute, perform and display the User Content (in whole or in part) on the Site, in our newsletters, on our social media channels, and in marketing or promotional material relating to TBJ, in any media now known or later developed.
By submitting User Content you warrant that:

You own or have all necessary rights, licences, permissions and consents to grant the licence in this clause.

Any individuals identifiable in the User Content (including your partner, family members, wedding guests, photographers, and vendors) have consented to its submission and possible publication.

The User Content does not infringe the intellectual property, privacy, publicity, confidentiality, moral or other rights of any third party.
-
The User Content is true, accurate, not misleading and not deceptive.

The User Content is not defamatory, obscene, unlawful, threatening, harassing or otherwise objectionable.

You will indemnify TBJ against any claim arising from a breach of these warranties.
TBJ has no obligation to publish, store, or use any User Content and may decline, edit, remove, redact or withdraw User Content at its sole discretion at any time, with or without notice.
13. Newsletter and direct marketing
By subscribing to our newsletter or providing your email address, you consent to receiving electronic messages from TBJ in accordance with the Spam Act 2003 (Cth). These messages may include editorial content, news, promotions, partner offers, product launches, and updates.
Every commercial electronic message will identify TBJ as the sender, include our contact details, and offer a functional unsubscribe option. You can withdraw consent at any time by clicking the unsubscribe link in any message or emailing hello@thebridaljourney.com.au. We will process unsubscribe requests within 5 business days.
14. Marketplace
The preloved goods Marketplace is provided to facilitate listings of pre-owned wedding-related items and connect Sellers with potential Buyers. Use of the Marketplace is subject to separate Marketplace Terms, which are incorporated into and form part of these Terms. In the event of inconsistency between these Terms and the Marketplace Terms, the Marketplace Terms prevail in respect of Marketplace activities.
TBJ is not a party to any sale contract between a Buyer and Seller. TBJ does not process payment for sold items. TBJ does not warrant the authenticity, condition, ownership, quality, fitness for purpose, or legality of any item listed. Refer to the Marketplace Terms for full provisions.
15. Vendor Directory
The Vendor Directory is a paid subscription service that enables wedding industry vendors to maintain a listing on the Site. Use of the Vendor Directory by vendors is subject to a separate Vendor Subscription Agreement, which is incorporated into and forms part of these Terms. In the event of inconsistency between these Terms and the Vendor Subscription Agreement, the Vendor Subscription Agreement prevails in respect of Vendor Directory activities.
16. Paid partnerships and sponsored content
TBJ offers paid partnership packages including (without limitation) editorial features, social media posts, newsletter inclusion, reel and video content, and bespoke campaign deliverables. These packages may be purchased by Vendor Directory subscribers or by other Commercial Partners.
Each paid partnership is governed by a separate Brand Partnership Agreement signed between TBJ and the Commercial Partner. Where no separate Brand Partnership Agreement has been signed, the following apply by default:

All fees are payable in full upfront in Australian dollars and are inclusive of GST unless stated otherwise.

Fees paid are non-refundable.

Commercial Partners provide a brief and trust TBJ's editorial judgement in execution. TBJ retains final editorial control over all published content.

TBJ does not guarantee any minimum impressions, reach, engagement, leads, sales or other commercial outcome. Performance metrics provided by TBJ are sourced from third-party platforms in good faith.

Commercial Partners warrant that all content, products, services, claims, and materials supplied to TBJ comply with the ACL, all applicable advertising standards and codes (including the AANA Code of Ethics and Therapeutic Goods Advertising Code where relevant), and all other applicable laws.

Commercial Partners indemnify TBJ against any third-party claim arising from content, products, services or claims supplied by the Commercial Partner.
17. Third-party links and services
The Site contains links to and integrations with third-party websites, social media platforms, payment processors (including Stripe), affiliate networks (including ShopMy), analytics providers, hosting providers, and other service providers. We do not endorse, control, or accept responsibility for the content, products, services, or practices of any third party. Your dealings with third parties are solely between you and that third party, subject to their own terms and privacy policies.
18. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the ACL, the Competition and Consumer Act 2010 (Cth), or any other applicable law that cannot lawfully be excluded, restricted or modified ("Non-Excludable Rights").
19. Disclaimer of warranties
To the maximum extent permitted by law and subject to your Non-Excludable Rights:

The Site and all TBJ Content, Third-Party Creative Content, listings, and services are provided on an "as is" and "as available" basis.

TBJ makes no representations or warranties about the accuracy, completeness, currency, reliability, suitability, security, or availability of the Site, TBJ Content, Third-Party Creative Content, listings, or services.

TBJ does not warrant that the Site will be uninterrupted, timely, error-free, secure, or free of viruses or other harmful components.
-
TBJ is not liable for any inaccurate, misleading or out-of-date vendor information, product information, pricing or availability.
20. Limitation of liability
To the maximum extent permitted by law and subject to your Non-Excludable Rights, TBJ (and its directors, employees, contractors, contributors, agents and successors) will not be liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, including (without limitation) loss of profits, revenue, goodwill, data, opportunity, anticipated savings, or reputational harm, arising out of or in connection with your use of the Site, the Marketplace, the Vendor Directory, any paid partnership, any TBJ Content, any Third-Party Creative Content, or any interaction with another user, even if TBJ has been advised of the possibility of such loss or damage.
Where TBJ's liability cannot be excluded but can be limited under the ACL, TBJ's liability is limited at its option to (a) re-supplying the relevant service; or (b) paying the cost of having the relevant service re-supplied.
In any event, TBJ's total aggregate liability to you in connection with these Terms, the Site, or any service provided by TBJ is capped at the greater of (a) the total fees you paid to TBJ in the 12 months immediately preceding the event giving rise to the liability; or (b) AUD $100.
21. Indemnity
You agree to indemnify, defend and hold harmless TBJ and its directors, employees, contractors, contributors, agents, affiliates and successors from and against all claims, demands, actions, losses, liabilities, damages, costs and expenses (including reasonable legal fees on a solicitor and own client basis) arising out of or in connection with:

Your breach of these Terms, the Marketplace Terms, the Vendor Subscription Agreement, or any Brand Partnership Agreement.

Your use of or access to the Site.
-
Your User Content.
-
Your infringement of any third party's intellectual property, privacy, publicity, confidentiality or other rights.

Your violation of any law or regulation.
-
Any transaction or interaction between you and another user or vendor.
This indemnity does not apply to the extent that the relevant loss or damage was caused by TBJ's gross negligence or wilful misconduct.
22. Viruses and harmful code
TBJ does not represent or warrant that the Site, any TBJ Content, any Third-Party Creative Content, or any file or data obtained through the Site is free from viruses, worms, trojan horses, ransomware, or other harmful components. You are responsible for scanning all material obtained through the Site. TBJ accepts no liability for any direct, indirect, consequential or economic loss arising from any virus or harmful code transmitted through or in connection with the Site.
23. Termination and suspension
TBJ may suspend, restrict or terminate your access to the Site, the Marketplace, the Vendor Directory, or any other service at any time, with or without notice, for any reason, including any actual or suspected breach of these Terms or any incorporated agreement.
On termination, you must cease all use of the Site and any TBJ Content. The provisions of these Terms that by their nature should survive termination will continue to apply, including clauses 7, 8, 9, 10, 12, 18, 19, 20, 21 and 29.
You are not entitled to compensation for any potential sales, listings, partnerships, or activities cancelled or affected by a suspension or termination.
24. Informal dispute resolution
If you have a dispute with TBJ arising out of or relating to these Terms or your use of the Site, you must first contact TBJ at hello@thebridaljourney.com.au with a written description of the dispute and the resolution you are seeking. TBJ will acknowledge your notice within 7 business days and will make reasonable efforts to resolve the dispute within 30 calendar days of receipt. Neither party may commence court proceedings (other than for urgent injunctive or equitable relief) until the informal resolution process has been exhausted.
25. Class action position
To the maximum extent permitted by law, you agree that any claim or dispute against TBJ shall be brought only in your individual capacity and not as a plaintiff or class member in any class action, collective action, or representative proceeding. This clause does not affect any Non-Excludable Rights or rights under the Federal Court of Australia Act 1976 (Cth) that cannot lawfully be excluded.
26. International use
The Site is operated from Australia. TBJ makes no representation that the Site is appropriate, available, or compliant with the laws of any country other than Australia. If you access the Site from outside Australia, you do so at your own initiative and are solely responsible for compliance with the laws of your jurisdiction. TBJ reserves the right to restrict access to the Site from any country or region at any time.
27. Changes to these Terms
TBJ may amend these Terms (and any incorporated agreement) from time to time. Any amendment takes effect from the first day of the calendar month following the date the updated Terms are posted on the Site, unless a longer notice period is required by law. The current version will always be available on the Site with the "Last updated" date. Your continued use of the Site after an amendment takes effect constitutes acceptance of the amended Terms.
28. Privacy
Our collection, use and disclosure of personal information is governed by our Privacy Policy, available on the Site. By using the Site, you also agree to be bound by the Privacy Policy.
29. Governing law and jurisdiction
These Terms are governed by the laws of Victoria, Australia. You and TBJ submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia, and the courts of appeal from them, in respect of any dispute arising out of or in connection with these Terms or the Site.
30. General

If any provision of these Terms is found to be unenforceable, it will be severed to the minimum extent necessary and the rest will remain in full force and effect.

Our failure to enforce any provision is not a waiver of our right to enforce it later. Any waiver must be in writing and signed by an authorised representative of TBJ.

You must not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to a successor business or affiliate on notice to you.

These Terms, the Privacy Policy, the Marketplace Terms, the Vendor Subscription Agreement, and any Brand Partnership Agreement constitute the entire agreement between you and TBJ in relation to your use of the Site, and supersede all prior communications.

No third party is intended to have any rights under these Terms (and no Contracts (Rights of Third Parties) statute will apply).

These Terms are written in English, which is the sole governing language.

Section headings are for convenience only and do not affect interpretation.

Marketplace Terms

1. About these Marketplace Terms
These Marketplace Terms ("Marketplace Terms") govern your use of the preloved goods marketplace function (the "Marketplace") on thebridaljourney.com.au (the "Site"), operated by The Bridal Journey Pty Ltd ACN 658 629 737 (ABN 52 658 629 737) ("TBJ", "we", "us" or "our").
These Marketplace Terms supplement TBJ's Website Terms and Conditions and Privacy Policy, which apply to all users of the Site. In the event of inconsistency between these Marketplace Terms and the Website Terms, these Marketplace Terms prevail in respect of Marketplace activities.
IMPORTANT NOTICE: THE MARKETPLACE IS AN ONLINE LISTING PLATFORM ONLY. TBJ IS NOT A PARTY TO ANY SALE CONTRACT BETWEEN A SELLER AND A BUYER. TBJ DOES NOT OWN, INSPECT, VERIFY, AUTHENTICATE, HOLD OR DELIVER ANY ITEM LISTED. TBJ DOES NOT PROCESS, COLLECT, HOLD OR REMIT THE SALE PRICE OF ANY ITEM. BUYER AND SELLER ARE RESPONSIBLE FOR PAYMENT, DELIVERY, INSPECTION, RETURNS, AND ALL OTHER ASPECTS OF THE SALE. TBJ'S ROLE IS LIMITED TO PROVIDING THE LISTING AND MESSAGING FUNCTIONS DESCRIBED IN THESE TERMS.
2. Definitions

"Buyer" means a person who uses the Marketplace to view or contact a Seller about purchasing an Item.

"Item" means a preloved bridal item listed by a Seller through the Marketplace, namely a wedding dress, veil, bridal shoes, or bridal accessory.

"Listing" means an Item listing published by a Seller on the Marketplace.
-
"Listing Fee" means the Standard Listing Fee or Premium Listing Fee payable by a Seller to TBJ to publish a Listing.
-
"Member" means a Buyer or a Seller.
-
"Sale" means a transaction between a Buyer and a Seller arising from a Listing.
-
"Seller" means a person who creates and publishes a Listing on the Marketplace.
3. Eligibility
To list an Item or to contact a Seller through the Marketplace, you must be at least 18 years of age, have legal capacity to enter binding contracts, and not be subject to any restriction that prevents you from selling or buying preloved goods. By using the Marketplace, you warrant that these requirements are met.
4. Creating a Listing
A Seller may create a Listing by completing the listing form on the Site, paying the applicable Listing Fee, and submitting the Listing for publication. Listings publish automatically once the Listing Fee is paid. TBJ may, at its sole discretion and without notice, remove, modify, or refuse to publish any Listing that does not comply with these Marketplace Terms, the Website Terms, or applicable law.
A Seller may only list one Item per Listing. A Seller must not change the Item to another item after the Listing is published. Each Listing must accurately describe the Item, including condition, size, designer, original retail price, asking price, and any defects or flaws. Photographs must be of the actual Item being sold and must clearly show any defects.
5. Listing Fees
The following Listing Fees apply (all amounts in Australian dollars and inclusive of GST):

Standard Listing - $24.95 per Item.

Premium Listing - $44.95 per Item.
Listing Fees are payable in advance via Stripe at the time the Listing is submitted. The Premium Listing offers enhanced visibility features as described on the Site. TBJ may amend Listing Fees from time to time by updating the Site; amended fees apply to Listings created after the change takes effect.
LISTING FEES ARE NON-REFUNDABLE. The Listing Fee is consideration for the listing service itself, not for any guarantee of sale. The fact that an Item does not sell, sells slowly, sells for less than expected, or is removed for a breach of these Terms does not entitle the Seller to a refund.
6. Listing duration
A Listing remains active until the Item is sold, the Seller closes the Listing, or TBJ removes the Listing. The Seller is responsible for promptly closing a Listing once the Item is sold or no longer available.
7. Permitted Items
The following Items may be listed on the Marketplace:

Pre-owned wedding dresses (worn or unworn).

Pre-owned bridal veils.
-
Pre-owned bridal shoes.
-
Pre-owned bridal accessories (including hair accessories, headpieces, jewellery, gloves, sashes and similar items).
8. Prohibited Items and conduct
The following are strictly prohibited on the Marketplace:

Replicas, knock-offs, counterfeit items, or any item misrepresented as the work of a designer that did not produce it.

Items by unknown or unverifiable designers where the designer cannot be substantiated.
-
Items not actually for sale (placeholder Listings, joke Listings, or test Listings).
-
Stolen items or items the Seller does not own and have full right to sell.
-
Items that infringe any third party's intellectual property, trade mark or design rights.
-
Non-bridal items, even if loosely related to weddings.
-
Promotion of any service, business, brand, or competing platform within a Listing.
-
Use of the Marketplace messaging function for harassment, spam, off-topic communication, or solicitation of off-Marketplace transactions.
9. Photographs and content licence
By submitting photographs, descriptions, or any other content as part of a Listing, the Seller grants TBJ a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable and transferable licence to use, reproduce, edit, adapt, publish, translate, distribute, perform and display that content on the Site, in TBJ newsletters, on TBJ social media channels, and in any TBJ marketing or promotional material, in any media now known or later developed.
The Seller warrants that all photographs are of the actual Item being sold, that the Seller owns or has all necessary rights in the photographs and descriptions, and that no third party's rights are infringed.
10. Messaging between Members
Buyers and Sellers communicate through the Marketplace messaging system on the Site. Members must not communicate sensitive information (including credit card details or personal identity documents) through the messaging system. TBJ may review messages for safety, abuse, fraud, and compliance purposes. Members must use the messaging system in good faith and only for the purpose of progressing a legitimate enquiry or sale.
11. Sale contracts are between Members
Any contract for the sale of an Item is formed directly between the Buyer and the Seller. TBJ is not a party to that contract, does not negotiate it, does not enforce it, and is not a broker, agent, escrow, or insurer for either party. TBJ does not collect, hold, or remit any portion of the sale price (whether by Stripe, PayPal, bank transfer, cash, or otherwise).
12. Payment between Buyer and Seller
Buyer and Seller are solely responsible for agreeing payment terms and processing payment directly between themselves. TBJ recommends that Members use a secure payment method that offers buyer and seller protection (such as PayPal Goods and Services). TBJ accepts no liability for any payment that is not made, is reversed, is fraudulent, or is otherwise disputed.
13. Delivery, returns and condition
Buyer and Seller are solely responsible for arranging delivery, postage, insurance, inspection and returns. TBJ does not handle, ship, store, inspect, or authenticate any Item. TBJ accepts no liability for items that are damaged, lost in transit, delayed, stolen, misdescribed, of unsatisfactory condition, or that do not arrive.
Items sold through the Marketplace may carry consumer guarantees under the Australian Consumer Law if the Seller is selling in trade or commerce. Otherwise, sales between private individuals are not generally covered by the ACL consumer guarantees, although general principles of misrepresentation and contract law apply.
14. Disputes between Members
Disputes between a Buyer and a Seller (including disputes about payment, delivery, item condition, authenticity, or returns) are the responsibility of those Members to resolve. TBJ will not mediate, arbitrate, refund any party, or take sides in any dispute between Members.
If a Member becomes aware of fraud, illegal conduct, or breach of these Terms by another Member, the Member may report it to TBJ at hello@thebridaljourney.com.au. TBJ may, at its discretion and without obligation, suspend or terminate the offending Member's account.
15. TBJ's removal and suspension rights
TBJ may, at any time and in its absolute discretion, with or without notice:

Remove or edit any Listing.

Suspend or terminate any Member's access to the Marketplace.

Refuse to publish or remove any photograph, message, or content.

Decline to register a new Seller or Buyer.
Reasons may include actual or suspected breach of these Terms, fraud, complaints from other Members, intellectual property concerns, or any other reason TBJ considers appropriate. Members are not entitled to compensation for Listings or activity affected by such action.
16. Member warranties and indemnity
Each Member warrants that:

All information provided to TBJ and to other Members is true, accurate, complete and current.

The Member owns or has full authority to sell each Item the Member lists, and the Item is not encumbered.

The Member's use of the Marketplace complies with all applicable laws, including tax obligations.

The Member will not use the Marketplace for any unlawful or fraudulent purpose.
Each Member indemnifies TBJ, its directors, employees, contractors and contributors against all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) the Member's breach of these Marketplace Terms; (b) any Item listed or transaction entered into by the Member; (c) any infringement of a third party's rights by the Member; or (d) any dispute between the Member and another Member. This indemnity does not apply to the extent that loss or damage is caused by TBJ's gross negligence or wilful misconduct.
17. Australian Consumer Law
Nothing in these Marketplace Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
18. Limitation of liability
To the maximum extent permitted by law, TBJ is not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage (including loss of profits, revenue, goodwill, data, opportunity, or anticipated savings) arising out of or in connection with the Marketplace, any Listing, any Sale, any conduct of any Member, or any failure of the Marketplace or messaging system.
Where TBJ's liability cannot be excluded but can be limited under the ACL, TBJ's liability is limited at its option to (a) re-supplying the relevant service; or (b) paying the cost of having the relevant service re-supplied.
In any event, TBJ's total aggregate liability to any Member in connection with the Marketplace is capped at the total Listing Fees paid by that Member to TBJ in the 12 months preceding the event giving rise to liability, or AUD $100, whichever is greater.
19. Termination
A Member may stop using the Marketplace at any time by ceasing to list Items and removing any active Listings. TBJ may suspend or terminate a Member's access at any time as described above. Clauses 9, 11, 14, 15, 16, 17, 18 and 20 survive termination.
20. Governing law
These Marketplace Terms are governed by the laws of Victoria, Australia. Each party submits to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
